- I, [Your Name], agree to participate in the SD Open which will involve me playing the sport of cricket and associated activities during the tournament season (the Event).
- The Event is operated by SDCCYA (San Diego Cricket Club Youth Academy) in conjunction with local cricket communities and volunteers (Organizers).
- I have had the opportunity to consider the risks associated with participating in the Event and confirm that:
- I have received adequate information in relation to these risks to enable me to make an informed decision as to whether I wish to participate in the Event;
- I understand all of these risks;
- I am aware that these risks could include injury, illness or death to participants in the Event (including myself) and damage to property;
- I have chosen to participate in the Event freely and voluntarily; and
- I freely and voluntarily accept any and all consequences which may arise as a result of my participation in the Event.
- I agree to obey and accept any instructions or rules in relation to the Event and to wear all safety and other equipment required.
- The Organizers reserve the right in their absolute discretion to refuse to allow me to participate in the Event if they consider that I am not in the mental or physical condition to safely participate in the Event or for any other reason.
- I understand that if any food or beverages are provided to me before, during or after the Event that it is my responsibility to check ingredients to ensure that the food is safe for me to eat in relation to any health condition or food allergy I have.
- I have not relied on any representations or warranties made by the Organizers in relation to the Event.
- To the full extent permitted by law, I waive all legal rights, actions and claims against the Organizers, that arise out of:
- my participation in the Event; any negligent or tortuous acts or omissions, breaches of duty, breaches of contract or breaches of statutory duty by the Organizers, the Released Parties or anyone else in connection with the Event; and
- any injury, loss or damage that I sustain as a result of my participation in the Event.
- I indemnify, and agree to keep indemnified, the Organizers, and their respective directors, employees, agents, officers, volunteers and contractors against all actions, claims, judgments, demands, losses, damages and costs arising directly or indirectly as a result of my participation in the Event.
- I warrant that, when participating in the Event, I will not:
- engage in any illegal or unsafe behavior;
- be under the influence of alcohol, drugs or any other substance; nor
- have any medical or other condition which may make it unsafe for me to participate in the Event.
- I agree that I may be photographed and/or filmed in connection with the Event (Content). I acknowledge and agree that all intellectual property rights including copyright in the Content will vest in the Organizers upon creation. I consent to the Organizers doing, or omitting to do, anything that would otherwise be an infringement of my moral rights. I acknowledge that the Organizers shall have full editorial control over the use of the Content and the Organizers may edit the Content in any way, in their absolute discretion.
- I consent to Organizers using my name, likeness, image, voice, performance, appearance, Content, and any other matter as recorded in all Content in any media for an unlimited period without remuneration for the purpose of promoting the Event, and promoting any products manufactured, distributed and/or supplied by the Organizers.
- I confirm that I have full authority to enter into this Deed and I understand the nature and subject matter of this Deed.
I am over eighteen (18) years of age (nineteen (19) in Alabama) and I have full legal capacity to grant this consent and release, and have read and understood the above consent and release prior to its execution. If I am under eighteen (18) (nineteen (19) in Alabama) years of age, my parent or guardian attests that he or she has read and understands the above waiver and consent prior to execution, and agrees to such waiver and consent.
